Using Chrono Symphonic

Am I allowed to use the Chrono Symphonic Tracks in my fangame, Chrono Limit?

Just checking to make sure I'm not doing anything bad.

Square Enix owns the material anyway, so it's not as if you must ask the permission of the remixers. Remixes are mostly illegal like fan games, so it works out.

ok i guess i won't be using Chrono Symphonic
but if remixes aren't allowed in games, why do games like Chrono Crisis and Chrono Stream feature a variation of some of the original Chrono Trigger Music?

I meant that fangames and remixes are both illegal, as the parent content is copyrighted by Square Enix. To use a remix, you would have to ask Square Enix, not the remixers. The same for creating a fan game or fan site. In both cases the answer would be no, so do what you like.

Let me explain this.  Square-Enix holds the copyright for the Crono Series.  If you make a derivative work using any content from the games (including characters, story, images or music) without SE's permission, then you would be infringing on their copyright.  Most remixes are illegal, but SE doesn't seem to mind.  The same goes for fan-games or even fan-fiction.  However, in the case of Chrono Resurrection, SE threatened legal action and forced the project to be shut down.

I suggest you go ahead an use whatever material you want for your game.  SE only seem to care about high-profile projects like Chrono Resurrection.

Basically don't become high-profile and if you do quickly change all of the names in your game... unless you feel like being a martyr like CR, in which case you modestly shut down and an angry mob of fans (... damn you square-enix damn you, where did you go so wrong?) gets pissed off at SE.
I pray SE does not try to sue Chrono Symphonic...  if it does...

SE'd be stupid to try to sue Chrono Symphonc.  The vast majority of its Final Fantasy fanbase is American, and without that, it's dead in the water.

In my mind, fan projects of any kind should fall under fair use, unless they're actively trying to make money for themselves at the expense of the original developers.  I can almost guarantee you that Squaresoft wouldn't have pulled that shit.  Enix is clearly the dominant entity in the corporation.
